The ITP process is designed to be fair, confidential, and independent. The following outlines the key stages of a complaint from submission to resolution.
Guiding Principles
Independence
The ITP operates independently of Hockey Canada and its Members, ensuring impartial administration of every complaint.
Confidentiality
All parties are bound by strict confidentiality obligations throughout the process to protect the privacy of everyone involved.
Procedural Fairness
Both the complainant and respondent have the right to be heard, to know the case against them, and to respond to allegations.
Timeliness
The ITP is committed to resolving complaints in a timely manner, with clear timelines communicated to all parties at each stage.
Step-by-Step Guide
Complaint Submitted
A complainant submits a maltreatment complaint to the ITP (Sport Dispute Management Inc.) using the appropriate provincial or territorial complaint form. The complaint must identify the respondent and describe the alleged conduct.
Initial Review
The ITP Case Manager conducts an initial review to determine whether the complaint falls within the scope of the Hockey Canada Maltreatment Complaint Management Policy. The complainant and respondent are notified.
Interim Measures
Where necessary to protect the safety of participants, the ITP may impose interim measures while the complaint is being processed. Interim measures are not a finding of wrongdoing.
Investigation
An independent investigator may be appointed to gather evidence, interview the parties and witnesses, and review relevant documents. The investigator produces a written report setting out their findings of fact.
Adjudication
An independent adjudicator reviews the investigation report (if applicable) and any submissions from the parties. The adjudicator issues a written decision determining whether a policy violation occurred and, if so, imposing appropriate sanctions.
Decision & Sanctions
The ITP provides the written decision to the parties, Hockey Canada, and the applicable Member. Sanctions, if any, are implemented. The parties are informed of any available appeal rights.
Appeal (if applicable)
A party who disagrees with the decision may have the right to appeal. The appeal process is governed by the applicable policy and must be initiated within the prescribed time limit.
